Zero Tolerance Policy

Black Swan Executive Chauffeurs, Inc. is committed to maintaining a safe, drug-free environment for both employees and clients. The use of illegal drugs, alcohol, and the misuse of prescribed and over-the-counter medications subjects employees and passengers to unacceptable safety risks. This policy applies to all employees, contractors, and representatives of Black Swan Executive Chauffeurs.

Prohibited Activities

The following activities are strictly prohibited and will result in immediate disciplinary action, up to and including termination of employment:

1. On-Premises Substance Use

The use, possession, solicitation for, or sale of narcotics or other illegal drugs, alcohol, or prescription medication without a valid prescription on Company or customer premises or while performing any assignment.

2. Off-Premises Impairment

Being impaired or under the influence of legal or illegal drugs or alcohol away from Company or customer premises, if such impairment adversely affects the employee's work performance, the safety of the employee or others, or puts at risk the Company's reputation.

3. Off-Premises Possession

Possession, use, solicitation for, or sale of legal or illegal drugs or alcohol away from Company or customer premises, if such activity adversely affects the employee's work performance, the safety of the employee or others, or puts at risk the Company's reputation.

4. Detectable Substances

The presence of any detectable amount of prohibited substances in an employee's system while at work, on Company or customer premises, or while conducting Company business is a violation of this policy.

Testing

Black Swan Executive Chauffeurs reserves the right to conduct drug and alcohol testing under the following circumstances:

  • Pre-employment: All prospective employees are subject to drug and alcohol testing as a condition of employment.
  • Random testing: Employees may be selected at random for unannounced drug and alcohol testing at any time during employment.
  • Post-accident: Any employee involved in a vehicular accident or safety incident will be tested immediately.
  • Reasonable suspicion: Testing will be conducted when a supervisor has reasonable cause to believe an employee is under the influence.

Consequences

Any employee who violates this policy or refuses to submit to testing will be subject to disciplinary action, up to and including immediate termination. A positive test result or refusal to test will be treated as a policy violation.
